These Terms of Service ("Terms") are a legal agreement between you and Garidium LLC ("RVCockpit", "we", "us", "our") governing your use of the RVCockpit web application at rvcockpit.com and any related services (collectively, the "Service").

Please read these Terms carefully. Section 8 (Disclaimers) and Section 9 (Limitation of Liability) limit our liability to you. By creating an account or using the Service, you confirm that you have read and agree to these Terms.

1. Acceptance

By creating an account, signing in, or using the Service in any way, you agree to be bound by these Terms and by our Privacy Policy. If you don't agree, don't use the Service.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract in your jurisdiction. By using the Service, you represent that you meet these requirements. If you're using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Your Account

• You're responsible for keeping your login credentials secure. Don't share your password.
• You're responsible for all activity that happens under your account.
• Provide accurate information and keep it up to date (especially your email — we use it for billing and account notices).
• One account per person. Don't impersonate someone else or create accounts under false identities.
• Notify us at sales@garidium.com if you suspect unauthorized access to your account.

4. Subscription, Billing, and Trials

Pricing

Paid plans are $10.00 USD per month or $100.00 USD per year, charged in advance. Prices are exclusive of any applicable taxes. We may change pricing for new subscribers at any time; existing subscribers will receive at least 30 days' notice before any price change applies to them.

Free trial

New subscribers receive a 7-day free trial. You must provide a valid payment method to start the trial. We will not charge you during the 7-day window. If you don't cancel before the trial ends, your subscription begins automatically at the rate shown when you signed up, and your payment method will be charged.

Auto-renewal

Subscriptions automatically renew at the end of each billing period (monthly or annual, depending on the plan you chose) until you cancel. By subscribing, you authorize us, through Stripe, to charge your payment method for each renewal until you cancel.

Payment processor

All payments are processed by Stripe, Inc. By providing payment information you also agree to Stripe's terms. We do not store your full card details.

5. Cancellation and Refunds

You may cancel your subscription at any time from Setup → Subscription → Manage subscription in the app, which opens the Stripe-hosted Customer Portal. Cancellation takes effect at the end of the current billing period — you keep access until then, and we will not charge you again.

No partial refunds. Except where required by applicable law, fees already paid are non-refundable. We do not provide pro-rated refunds for unused time in a paid period or for canceled annual plans.

If your account is terminated for violating these Terms, you forfeit any unused subscription time.

6. Acceptable Use

You agree not to:

• Use the Service in violation of any law or these Terms.
• Reverse-engineer, decompile, or attempt to extract source code or non-public APIs.
• Scrape, harvest, or otherwise systematically extract data from the Service.
• Resell, sublicense, or commercially redistribute the Service or its outputs without our written permission.
• Use the Service to send spam, phishing, malware, or any unlawful, threatening, abusive, defamatory, or obscene content.
• Upload content you don't have the right to upload (including photos of others without their consent where required).
• Interfere with the Service's operation, abuse rate limits, or attempt to circumvent access controls or quotas.
• Use automated tools, bots, or scripts to interact with the Service without our written permission.
• Misuse the AI copilot — you may not use it to generate disallowed content or to extract information about other users.
• Share account credentials with others.

We may investigate suspected violations and may suspend or terminate accounts at our discretion.

7. Your Content

You retain ownership of the trips, photos, notes, captions, and other content you create or upload through the Service ("Your Content"). To operate the Service, you grant us a worldwide, royalty-free, non-exclusive license to host, store, transmit, display, reproduce, and process Your Content as necessary to provide the Service to you and the recipients you authorize.

If you mark a photo or note as public, you also grant us and other RVCockpit users a license to display that content within the Service's public/community feeds. You can delete public content at any time.

You represent that you have all rights necessary to upload and share Your Content and that doing so does not violate any law or third-party rights.

We may, but are not obligated to, remove content that violates these Terms or that we believe is harmful or unlawful.

8. Disclaimers — Read This Section Carefully

Routing and POIs

Routes, distances, drive times, and POI locations are computed from third-party data (Mapbox, Google, OpenStreetMap, public datasets) and may be incomplete, outdated, or inaccurate. Generated routes are not verified to be RV-suitable; we cannot guarantee a route avoids low bridges, narrow roads, weight-restricted bridges, restricted parkways, dirt roads, or other obstacles dangerous to RVs.

Low-bridge alerts

Bridge clearance data is sourced from the FHWA National Bridge Inventory and similar public datasets. This data is best-effort, may be outdated, and does not include every overpass. Always verify clearance against current physical signage at the bridge before driving under it. We are not liable for damage caused by relying on bridge alerts.

Weather, fuel, and elevation data

Weather radar/forecasts (NWS), fuel prices, and elevation profiles are estimates from third parties and may be inaccurate or stale. Don't rely on them for decisions where accuracy is critical.

Live location sharing

Live location sharing depends on your device's GPS, your network connection, and our infrastructure. It may be delayed, inaccurate, or interrupted. Don't rely on it for safety-critical scenarios.

AI features

The AI copilot uses third-party large language models. Its output may be inaccurate, fabricated, or out of date. Verify any factual claim or routing recommendation independently before acting on it.

9. Limitation of Liability

To the fullest extent permitted by law:

• In no event will Garidium LLC, its members, officers, employees, or contractors be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including (without limitation) lost profits, lost data, vehicle damage, personal injury, business interruption, or any damages arising from accidents, missed reservations, or denied entry to a campground or facility, even if we have been advised of the possibility of such damages.
• Our total cumulative liability to you for all claims arising from or related to the Service is limited to the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100.00).
• Some jurisdictions do not allow the exclusion or limitation of certain damages. To that extent, the limits above apply only to the maximum extent permitted in your jurisdiction.

10. Indemnification

You agree to indemnify, defend, and hold harmless Garidium LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

11. Suspension and Termination

• You may stop using the Service at any time. To delete your account, email sales@garidium.com from the account's email address.
• We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, are creating risk or legal exposure for us, or for any other reason at our discretion.
• Upon termination, your license to use the Service ends. The disclaimers, limitations of liability, indemnification, and dispute provisions of these Terms survive termination.

12. Changes to the Service or Terms

We may modify, add, or discontinue features at any time. We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date at the top of these Terms and, where significant, notify you by email or an in-app notice. Continued use of the Service after the changes take effect means you accept the updated Terms.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. You agree that any dispute arising from or related to these Terms or the Service will be brought exclusively in the state or federal courts located in St. Lucie County, Florida, and you consent to the personal jurisdiction of those courts.

14. General

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior agreements.
• Severability. If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
• No waiver. Our failure to enforce any right is not a waiver of that right.
• Assignment. You may not assign these Terms without our written consent. We may assign these Terms to a successor in connection with a sale, merger, or reorganization.
• Notices. We may give notices by email to your account address or by posting in the app. You may give notices to us at the contact address below.
• No third-party beneficiaries. These Terms are solely between you and us; nothing creates rights for any third party.
